Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and AimPoly LLC, a Wyoming limited liability company (“AimPoly”, “we”, “us”) for the CollectAim app and related services (“CollectAim”). CollectAim is licensed to you through the App Store under Apple's Licensed Application End User License Agreement (“Apple EULA”). These Terms add to the Apple EULA; if they conflict, these Terms apply to the extent the Apple EULA allows. By using CollectAim you accept these Terms.

2. Using CollectAim

You may use CollectAim for personal, non-commercial purposes on Apple devices you own or control, as permitted by the App Store's Usage Rules. You're responsible for the photos you take or import and the names you enter. Please only use photos you have the right to use, and don't use CollectAim to:

• identify, track or profile people — CollectAim doesn't identify people, and you must not try to make it;
• photograph people or private places in ways that break the law or someone else's privacy;
• upload content that is illegal, sexual involving minors, hateful, or that promotes violence or self-harm;
• probe, overload or reverse-engineer our server, or use it outside the app (for example by scripting requests);
• resell or redistribute CollectAim or its AI output as a service.

We may limit or block access to identification for use that breaks these rules or threatens the service.

3. Free and Pro

The free version includes 3 discoveries a day (a discovery is a photo that gets identified; photos that can't be identified, and re-scans the app recognises on your iPhone, don't count), every card design and foil, the 3D rooms, card videos and the monthly wrap. Sharing a card can earn extra discoveries, up to a monthly limit. CollectAim Pro adds unlimited discoveries, the discovery map and the full story on every card. “Unlimited” is subject to a fair-use limit that keeps the service reliable for everyone; ordinary use won't reach it.

Cards you've collected stay in your collection, with their designs, if Pro ends.

Plans

Prices differ by country and are shown in the app and on the App Store in your local currency before you buy; the price shown at checkout is the one that applies.

Subscriptions

• Payment is charged to your Apple Account when you confirm the purchase.
• A subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel at any time in Settings → [your name] → Subscriptions. Cancelling stops the next renewal; Pro stays active until the end of the period you've paid for.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• If a price changes, Apple will notify you in advance as required, and you can cancel before it applies.

Restore purchases on a new device from Settings in the app.

4. AI identification

Identification sends the information described in our Privacy Policy to our server and to our AI provider, Anthropic, to name what's in a photo and write about it. AI output is produced automatically and may be inaccurate, incomplete or unsuitable. Names, facts and “More about” texts are for enjoyment and general interest. You can correct a card with “Not quite right?”; a correction is checked against the photo and may not be accepted. We may change, limit or discontinue AI features, including by setting fair-use limits, to keep the service reliable.

5. Safety: not for foraging, not professional advice

Identifications can be wrong. Never use CollectAim to decide whether a plant, mushroom, berry, fruit or animal is safe to eat, touch or handle, or whether it has any medical use. Many edible species have poisonous look-alikes. If someone may have been poisoned, contact a poison control centre or emergency services right away.

CollectAim does not provide medical, safety, legal or financial advice. Rarity tiers are estimates for a game of collecting: they come from a shared rarity table and, for wild species, from public sighting records, and say nothing about conservation status, value or authenticity. Don't disturb wildlife, enter private or protected land, or take plants, fungi or animals to make a card.

6. Your data

Your collection is stored on your device and in your own iCloud. You're responsible for keeping it — keep iCloud on for CollectAim or use your iPhone's backups. We can't recover your cards, because we don't have a copy.

7. Intellectual property

CollectAim, including its card designs, foils, rooms, artwork, code and name, belongs to AimPoly and its licensors and is protected by law. You keep the rights to your photos. You may share your cards and card videos, including on social media. These Terms don't give you any rights to our trademarks. If you send us feedback, we may use it without obligation to you.

8. Changes and availability

We may update CollectAim, add or remove features, or stop offering it. If we update these Terms, we'll post the new version here with a new effective date; material changes will be noted in the app's release notes. Continuing to use CollectAim after changes take effect means you accept them.

9. Disclaimers

CollectAim is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't guarantee that CollectAim or its identifications will be uninterrupted, error-free or accurate.

10. Limitation of liability

To the fullest extent permitted by law, AimPoly isn't liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of CollectAim, including any reliance on an identification. Our total liability for any claim is limited to the amount you paid for CollectAim in the 12 months before the claim. Some jurisdictions don't allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have as a consumer that can't be waived under your local law.

11. Termination

You can stop using CollectAim at any time by deleting it. If you seriously or repeatedly break these Terms, we may end your access to identification. Sections 5, 7, 9, 10 and 12 survive termination.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, and applicable U.S. federal law, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.

13. Apple

You acknowledge that these Terms are between you and AimPoly, not Apple. Apple isn't responsible for CollectAim or its content, has no obligation to provide maintenance or support, and isn't responsible for handling claims relating to CollectAim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
